Yes. He has a package offer of a free Pirelli test, black helmets for the drivers and a reprimand from FIA. It's proven quite succesful on the market since its introduction earlier this year.

Remember that the FIA can turn a blind eye to rule contraventions. It is fully up to the FIA President to decide to pursue a prosecution by referring a matter to the International Tribunal. E.g. see examples where teams have broken aerodynamic rules but have not been prosecuted, simply asked to stop.
It would be politically difficult for the FIA President not to prosecute where some team gained an advantage over others.
But if the FIA imply "in this situation, we won't care about the rule contravention", and all the teams are involved (so no-one is going to complain), then it won't matter how things are "interpreted" as it won't get that far.
What they are really asking the FIA, in my view, is "specifically under what conditions will you turn a blind eye to rule contravention in this area".

Actually the whole story is kind of funny. If they are permitted to undergo a Pirelli test with their current car, that would automatically mean Mercedes' ban from the YDT is lifeted. Pirelli needs those tests just as much as it is in the interest of the teams. Just shows how shortsighted Horner was.
edit: while it certainly is hilarious, who else should they ask? Whiting is the only one in position to coordinate. Always has been. Todt has said when elected that he is abandoning the hands-on attitude of MM in everyday policing, but failed as yet to establish a structure that provides for that. So here we are.

Now had the FIA given Mercedes a punishment, say a CC points dock, Redbull would have probably gone away quietly. But by not punishing them, the FIA have left themselves exposed. Back in the day Bernie and Max would have worked together to ensure the other teams were placated and the sport could move on. But there seems to be a lack of that with this affair.
Aren't we due FIA Presidential Elections this year?
