Have I missed something here? How does someone have "the power to enjoy" the income of a circuit owner if they co-ordinate the renovation of the circuit, tell the builders what kind of hospital to build and what sort of run-off areas to use? This looks like an error at the heart of what Bernie says was the threat against him... Just askin. :smoking:

In the new environment where people - and even the UK tax authorities - are starting to question and unpick tax avoidance strategies, Bernie's clever plans are beginning to unravel. The question is whether HMRC or the Grim Reaper will get to him first.

Surely having the power to enjoy income means spending it? If the Bernmeister just advised the builders at Ricard then he didn't spend it which would mean that he couldn't have been liable for the tax on it which means that this wouldn't have been a serious threat......
