Two parties freely signed a binding contract. One side failed to failed to complete it's part of the agreement and was forced to pay up per the terms of that contract.Just what exactly did Bernie do to earn the money?

The side that did not follow through on it's promises was not Bernie.

Racing fans can be the most thoughtful and enjoyable people to talk to on the planet, and the most entitled and obnoxious at the same time. Racing isn't there for us, even if it's there because of us.
If the sponsorship and corporate money disappeared overnight there would still be racing. At least until the NIMBYs have a cry over noise and get the last track closed.

What does this have to do with fans? .... a developer forfeited ...... and the outcome is a fairly normal one in this situation - in fact it looked like it was the developer's choice to go down that route .... they are a listed company - why are you crying for them???

If you recall the announcement in 2005, Bernie said it was a great day for the fans. What does this have to do with fans? .... a developer forfeited ...... and the outcome is a fairly normal one in this situation - in fact it looked like it was the developer's choice to go down that route .... they are a listed company - why are you crying for them???
In the end it was only a great day for Bernie.
There is no blame here.
And I'm not crying for anyone, other than the fans that may have been looking forward to visiting this park with their family.
Deals go south all the time. Particularly in F1. I admire BE for covering his butt and winning out almost every time.
