I wonder if any teams had enough time to develop a new rear wing. As it stands, no team has failed the test in Brazil or Qatar. But if the stewards are permitting you to fail a test, why would you pass it?

Makes perfect sense. Give teams time to adjust to the new tests like they were given earlier in the season. Seems fair.

What I mean is, the stewards have said we will turn a blind eye to this test. So a team should be trying to fail it. I think without the cost cap we would have seen teams show up with wings that failed the test in Saudi Arabia. If it's worth as much as RB think, teams should be falling over themselves to fail it.

They still have to pass this year's test. That's all that matters for this year. This other test, is nothing more than a test of next year's proposed test. Testing this year's wings with next year's test, will give F1 an idea of whether not they on the right track to determining the Mercedes trick, or at least getting RB off their case.

Well, then the argument that it takes time to adjust would no longer hold any value, does it? If you can work to fail the test in two weeks time, you would also be able to work to comply to it.

The protest will (in my view) likely not be upheld, but it will become another legal drama...

Yeah I agree.
But that's not how Toto Wolff and Horner have viewed it.
Wolff said Mercedes contemplated protesting RB if they'd run their 'flexi' wing in Baku, despite the new test being introduced the following race. RB also contemplated protesting Mercedes in Qatar if they'd run their (alleged) flexi wing, even though the wing met all the tests currently in place.
The reason is that the principle of the rule is that bodywork must be rigidly secured (in principle no flexing allowed, but we all know this is bs). Nevertheless, it's an opening for a team to lodge a protest. The protest will not be granted.
